PelliLive Terms of Service

These terms are an agreement between you and The Pelican Agency, LLC, a California limited liability company doing business as Pelli Family Pins and PelliLive ("we," "us"), which runs PelliLive™ at pellilive.com. They apply when you create a PelliLive account, sign in, or use any PelliLive tool, graphic, game, or guide. If you don't agree, please don't use PelliLive.

1. Not affiliated with Whatnot or OBS

PelliLive is an independent service. It is not affiliated with, endorsed by, or sponsored by Whatnot or the OBS Project. You are responsible for following Whatnot's own rules and terms when you run your shows, including the rules for giveaways. Whatnot or OBS may change how their products work at any time, and some PelliLive features may stop working or change as a result.

2. Your permission to use PelliLive

While your account is active (and paid, if your plan has fees), we give you a limited, personal, non-exclusive, non-transferable permission to use PelliLive for your own live shows. You don't buy or own any part of PelliLive. We can change, add, or remove features at any time.

3. What we own

We own PelliLive and everything in it: the software, tools, games and the way they are designed and presented, graphics, animations, overlays, sounds, layouts, written guides, and the names and logos PelliLive™ and Pelli Family Pins™. These terms don't transfer any of that to you. If you send us ideas or feedback, we may use them freely without paying you or giving you credit.

4. What you agree not to do

You agree not to:

• copy, resell, rent, sublicense, or share PelliLive, or let anyone outside your own shows use your account, sign-in, or graphic links;
• take apart, decompile, reverse engineer, scrape, or inspect PelliLive's code or data to learn or copy how it works;
• use PelliLive, or anything you learned only from your account, to build, design, or help someone else build a competing product or service;
• remove or hide any copyright, trademark, or "PelliLive" notice;
• use bots, fake accounts, or any other trick to inflate taps, shares, votes, or other counts;
• use PelliLive in a way that breaks the law or Whatnot's rules.

5. Keep it confidential

Everything you can see only after signing in is confidential. That includes the tools, settings, setup guides, unreleased features, and any pricing we don't publish. Don't share it, post it, or show it to anyone except people helping you run your own shows, and make sure they follow these terms too. This promise continues after your account ends.

6. Your content and data

You own your show content and your own data. You let us store and process it as needed to run PelliLive for you. We may use combined statistics that don't identify you or your shows to improve and promote PelliLive. Our Privacy Policy explains more.

7. Fees

You agree to pay the fees shown when you sign up. Fees are non-refundable except where the law requires otherwise. We'll give you at least 30 days' notice before changing what you pay.

8. No guarantees

Live shows depend on Whatnot, OBS, your computer, and your internet connection, none of which we control. PelliLive is provided "as is." We don't promise it will run without interruption or errors, or that any count, leaderboard, or result will match another source exactly. You are responsible for checking giveaway winners and anything else that matters to your business before you rely on it.

9. Limits on our responsibility

To the fullest extent the law allows, we aren't responsible for lost sales, lost profits, lost data, or any indirect damages, and our total responsibility for any claim is limited to the fees you paid us in the 3 months before the claim.

10. Ending your account

You can cancel at any time. We can suspend or close your account if you break these terms or don't pay. When your account ends, your permission to use PelliLive ends too. Sections 3, 4, 5, 8, 9, and 11 continue to apply after that.

11. Which law applies

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in California, unless the law requires otherwise.

12. Changes to these terms

We may update these terms. We'll change the date at the top, and for important changes we'll tell account holders by email or in PelliLive. If you keep using PelliLive after a change, you accept the new terms.
